The law over financial assistances of the federation for the improvement of traffic conditions of the municipalities (GVFG, here Download) permits a Bezuschussung for the procurement of vehicles and operating yards (investment conveyances) to the transporting enterprises.
In the case of this promotion it concerns a politically wanted structure promotion, on those only once no legal claim insists (differently z. B. as on the balance achievements after §45a PBefG or §148 SGB IX). The investment conveyances after the GVFG contain a long-term ÖPNV - referred appropriation. Vehicles and operating yards over the GVFG - means to be bezuschusst, must during a certain period (vehicles mostly 8 years, Mostly 25 years) the purpose serve operating height.
The background is (politically wanted) a qualitative structure improvement and stands for all transporting enterprises to same conditions for order.
If a Verkehrsunternehmer operates a line now in the ÖPNV or on behalf concession owner a line (or also several) served, the Verkehrsunternehmer can with the authorizing agency (in each Land of the Federal Republic another, set for example the district government) a request to vehicle promotion. This request must be placed at the beginning of the yearly and it must be proven, that one the promotion reason (ÖPNV) fulfills. This happens z. B. by collecting main of the linear network and the timetable. At the same time also an offer must be attached to the request. The vehicle must meet the purposes of the ÖPNV, thus definitely no touring buses are bezuschusst. Depending upon default of the respective authorizing agency the vehicle must fulfill additional functions (z. B. Niederflurbus). These things must be inquired at the respective authorizing agency first. For some vehicles there are higher and for other fewer subsidies.
A subsidy for a vehicle is granted, so the vehicle MUST be procured still in the same financial year. This can lead already once to difficulties, if the manufacturer of the bus has longer delivery times.
The height of the subsidy depends on different factors:
- How did many other transporting enterprises place a request in this year?
- Which would like particularly to promote the respective authorizing agency this year (Niederflurbus, Gelenkbus, etc.)?
- Did one place or is requests in the last years already one already longer time without promotion expenditure-comes?
A small Verkehrsunternehmer, only every few years a request places, a larger promotion for the vehicle is surely received, as a large transporting enterprise, each year procures 20 new vehicles.
The promoted vehicles must be used during the appropriation phase (mostly 8 years) predominantly in the regular transport service. This must be proven by time at present. Then one receives the request from the authorizing agency, the proof for the tax exemption to furnish (vehicles of the regular transport service to more than 50% are used in the regular transport service, Kfz are tax-exempt -). With this proof the authorizing agency is satisfied. The vehicles may be used naturally also in opportunity traffic, the predominant employment MUST take place however in the regular transport service for the improvement of the ÖPNV.
