After the social legislation (SGB part of IX) (left to the pdf - Download) the free transport of severely disabled ones is regulated (in former times §62 of the SchwbG). Afterwards the transporting enterprises are obligated, To carry forward severely disabled one with a valid severely disabled document of identification free of charge in accordance with the entries in the severely disabled document of identification. From each obligation naturally also a reconciliation of the obligation must come. The legislator regulated the obligation to pay compensation for the suburban traffic in the §148 SGB IX and for long-distance traffic in the §149 SGB IX (social legislation part of 9).
Determination of the balancing amount
The driving money losses are refunded with a percentage of the driving money incomes in the suburban traffic (same for long-distance traffic), proven by the enterprise. To the driving money incomes all yields from the ticket sales including more increased belong transport-repaid and incomes from the transport of hand baggage, Patient elevators, and.s.w.
Example of the computation the balancing amount:
Driving money incomes x Percentage = Balancing amount
1.000.000 euro x 2.15% = 21,500 euro.
The driving money incomes must be proven by the transporting enterprise. This means, that the driving money incomes by a tax counsel or a chartered accoutant to be confirmed must.
If the transporting enterprise operates line ways over several Lands of the Federal Republic, must the driving money incomes on the different Lands of the Federal Republic be divided and separate requests placed.
Percentage determine
The percentage is used for each country of the federal state government in each case for one year admits given and for the computation on the hundredths. The computation of the percentage takes place after a key, that the expenditure of the money tokens spent in the period considers and the population existing in the area over 6 years for this in relation places. Details can be reread in the §148 SGB IX.
The percentage determined by the federal state government can be increased by the transporting enterprise, if the operatingindividual value is larger around more than 1/3. The transporting enterprise with a counting must lead this proof.
The proof is led, the operatingindividual percentage may be used and accordingly more highly is the balance achievements with the formula.
Disbursement of the amount of subsidy
In the course of the restitution proceedings must the transporting enterprise up to 31.12. provide the request with the authorizing agency of the countries for the preceding financial year. In long-distance traffic the request must be placed with the office for federal administration.
The enterprises receive 80% of the Erstattungsbetrages determined last as pre-payment for the current calendar year. The pre-payments become ever the half 15. July and to 15. November paid.
The countries and the federation classify among themselves, who must take over which height of the balancing amount. The balancing amount is thus paid in two subtotals to the transporting enterprises.
